WS debate on ABS and dual functions
A debate at the Signet Library 6 – 7.30 pm 15 March will address the pros and cons of alternative business structures (ABS) and the dual function of the Law Society of Scotland (LSS) of both regulating and representing solicitors.
The issue of ABS is to be considered at a special general meeting of LSS to be held by 25 March, following a requisition from the Scottish Law Agents Society which is calling for a reversal of the pro - ABS vote at LSS’ annual general meeting in 2008. The reignited debate on ABS has also raised questions about the role of LSS, with a recent poll finding that 78% of respondents do not wish LSS to continue to represent solicitors as well as regulate them.
The WS Society’s Chief Executive Robert Pirrie said: “Whilst the Law Society of Scotland has its own series of road shows and has a special general meeting later this month, it is part of the WS Society’s purpose as an independent membership body to facilitate open discussion and assist solicitors to make their views known. We have done this before on ABS and related issues and we’re doing so again in response to renewed debate.”
In evidence to the Scottish Parliament, the WS Society’s senior office bearer Caroline Docherty and Chief Executive Robert Pirrie took a neutral line of ABS but raised questions about whether, once the Bill is enacted, it is tenable for LSS to continue to represent as well as regulate solicitors.
